  • Warmy Home Goods L.L.C. owns and runs Warmy & Tummy. In accordance with this Privacy Statement, Warmy & Tumy, Warmy Home Goods, and all of our subsidiaries and affiliated businesses (collectively, "Warmy Home Goods," "we," or "our") collect, use, and disclose your personal information. When you access or use our websites, mobile applications, and other online products and services (collectively, "Services") or otherwise interact with us, like through our customer support channels or on social media pages, we may collect information about you. This Privacy Policy is applicable to that information.

 

This privacy notice may occasionally change. If we make a change, we'll let you know by updating the policy's top date. In the event that we make significant changes to this Privacy Notice, we may also give you additional notice (such as by including a statement on the Services (described above) or by sending you a notification).   • PERSONAL INFORMATION WE COLLECT

Depending on how you interact with us, we may collect different types of personal information. When you use our Services, we automatically record information about you, and we also get information from other places, like organizations.

  • Information You Provide to Us Directly

We collect information that you provide to us directly. For example, when you create an account, fill out a form, submit or post content through our Services, make a purchase, communicate with us via third-party platforms, participate in a contest or promotion, request customer support, or otherwise communicate with us, we collect information directly from you. We collect information such as your name, email address, postal address, phone number, and any other information you choose to provide. Furthermore, if you make a purchase, we will collect and process your payment information through a third-party payment processor.

  • Information Collected Automatically

  • Device and Usage Details.We collect information about how you use our Services. This includes information about the device and network you use to access the Services, such as your Internet protocol (IP) address, user settings, MAC address, mobile carrier, mobile advertising, and other unique identifiers, browser or device information, your approximate location based on your IP address, and your Internet service provider. We also keep track of what you do on our Services, such as the pages you visit before, during, and after using our Services, the links you click, the types of content you interact with, how often and for how long you use our Services, and other information about how you use them.
  • Transactional Information.When you buy something or send something back, we collect information about the transaction, such as the details of the product, the purchase price, and the date and place of the transaction.
  • Information Collected by Cookies, Pixel Tags/Web Beacons, and Similar Tracking Technologies.We, along with third parties who provide content, advertising, or other functionality on our Services, use tracking technologies such as cookies, pixel tags, local storage, and other technologies ("Technologies") to collect information regarding your interaction with our Services. Cookies are small text files that are stored on your computer's hard drive or in the device's memory to remember your preferences and enhance your experience. Pixel tags (also known as "web beacons") are electronic images that we employ on our Services and in our emails to aid in the delivery of cookies, the counting of visits, and the analysis of the effectiveness of our advertising campaigns.   • Information Collected from Other Sources

We acquire information from third-party sources. For instance, we may obtain information about you from other merchants using the Warmy Home Goods platform. We may also obtain information about you from third-party services and organizations, including identity verification services, financial services providers, data brokers, advertising networks, data analytics providers, and mailing list providers. This information may contain identifiers such as your real name, alias, mailing address, or other similar identifiers, as well as inferences pertaining to your consumer preferences, characteristics, and predispositions. Additionally, if applicable, if you create or log into your account with us through a third-party application, such as an app store, a third-party login service, or a social networking site, we will have access to certain information from that application, such as your name, birthday, and profile picture, in accordance with the application's authorization procedures.

  • Information We Derive

From the data we collect, we may be able to figure out things about you or make assumptions about you. For example, based on previous interactions with our Services, we may infer your approximate location or your interest in specific products based on your IP address.

  • HOW WE USE YOUR INFORMATION

We use the information we collect to provide our Services and deliver the products you have requested, to tailor your experience with us, and to develop and improve new products and services. We also use the information we collect to:

  • Communicate with you about products, services, and events offered by us, other merchants that operate on the Warmy Home Goods platform, and others (for information on how to opt out of these communications at any time, see "Your Privacy Rights and Choices" below);
  • Evaluate the possibility of acquiring new Warmy Home Goods retailers;
  • Analyze and track trends, usage, and activities associated with our products and services;
  • Target ads on third-party platforms and websites (for more information and to opt out, see "Your Privacy Rights and Choices" below);
  • Personalize the advertisements you see when using our Services based on information provided by our advertising partners or by other merchants using the Warmy Home Goods platform (for more information and to opt out, see "Your Privacy Rights and Choices" below);
  • Facilitate contests, sweepstakes, and promotions, as well as process and distribute entries and prizes;
  • Help Warmy Home Goods and others protect their rights and property by finding, investigating, and stopping security incidents and other bad, deceptive, fraudulent, or illegal behavior;
  • Comply with our financial and legal responsibilities; and
  • Carry out any other purpose described to you at the time the information was collected.

 

  • TARGETED ADVERTISING AND ANALYTICS

We use third-party vendors for analytics, ad serving, and other services across our websites and mobile apps. These parties may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Service and other websites and applications. This information could include your Internet Protocol (IP) address, information about your web browser, information about your mobile network, the pages you view, the amount of time you spend on pages or in mobile apps, the links you click, and information about conversions. We may use this data to better understand how our Service and the websites of other companies are used, to analyze and track data, to determine the popularity of certain content, and to provide you with advertising and content tailored to your interests. Thanks to some of our advertising partners, we can convert your email address or phone number into a generic identifier that cannot be traced back to a specific person. In turn, our advertising partners will use this identifier to provide you with more targeted advertisements while you browse the web or use mobile applications. It's possible that some of the actions described in this section constitute "targeted advertising," "sharing," or "selling" in the context of those laws.   • Disclosure Of Information

We give out personal information in the following situations, or when this policy says otherwise:

  • The information we gather may be shared with other businesses in the Warmy Home Goods family.
  • Companies that help us run our business and need access to your personal information include those that give us IT services, web hosting, payment processing, customer service, banking and legal services, insurance, and similar help.
  • If you write a review of a product or post other content for others to see on our Services, we will make that review or content available to the public.
  • We reserve the right to disclose your personal information if we are under a good faith belief that doing so is necessary to comply with, or is required by, any law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • We may share personal information if we think your actions go against our user agreements or policies, if we think you have broken the law, or if we think it is necessary to protect the rights, property, and safety of Warmy Home Goods, our users, the public, or others.
  • In order to protect and manage our business interests, we may share personal information with our lawyers and other professional advisors.
  • We share personal information when a merger, sale of company assets, financing, or acquisition of all or part of our business by another company is planned or in the process of being negotiated.
  • Information about individuals is shared within Warmy Home Goods and among its current and future parents, affiliates, subsidiaries, and other companies controlling, or under common ownership with, Warmy Home Goods.
  • We disclose personal information with your consent or at your direction.

We also share information about you that has been grouped together or taken out of context so that it can't be used to find you.

  • YOUR PRIVACY RIGHTS AND CHOICES

  • Access, Correction, Deletion.You may have the right to (1) inquire about and obtain a copy of your personal data, (2) have your personal data erased, and (3) have incorrect data rectified. You may contact us as detailed in the "How to Contact Us" section below to request access to, or the correction or deletion of, your personal information. Your online account dashboard may also allow you to review, update, or delete some of your personal information. In order to confirm your request, we might ask you for additional information about yourself or your recent dealings with us. Please be aware that you may have the right to appeal our decision if we deny your request to access, delete, or correct your information.
  • Opting out of Targeted Advertising, Sharing, and Sales.We process personal information to better understand and improve your experience with our Services and to serve you advertisements on non-Acquired Brand properties, as described above in the Targeted Advertising and Analytics section. Some of these operations may constitute "targeted advertising," "sales" of your personal information, or "sharing" of your personal information under the law that applies to you. You can stop us from using your personal information for targeted advertising, sharing, and selling purposes by clicking here. You can also visit our Services with a recognized universal choice signal enabled to opt out of certain targeted advertising, sharing, and sales (such as the Global Privacy Control). You should know that our processing of your opt-out preference signal may be restricted to the browser or device you are currently using if you are not logged into your account with us. If you switch between browsers or devices that access our Services, you may need to renew your opt-out.
  • Non-discrimination.If you choose to exercise your right to privacy, you will face no repercussions from us.
  • Communication Preferences.If you no longer wish to receive promotional texts or emails from us, please follow the unsubscribe instructions provided. Even after you unsubscribe from receiving promotional emails from us, we may still send you emails about your account or our ongoing business relations.
  • OtherWarmy Home GoodsMerchants. When you shop at one of the Warmy Home Goods-affiliated stores, we share your contact details with those stores so that they can send you offers and news.
  • Mobile Push Notifications.We would like to send push notifications to your mobile device and need your permission to do so. Changing your mobile device's notification settings will permanently disable these messages.
  • Cookies.By default, most browsers will allow cookies. Most browsers allow you to delete or reject cookies if you prefer. If you choose to disable or delete cookies, our Service may not function properly or at all.

 

  • DATA RETENTION

We keep your personal information for as long as your account is active. If you cancel your account on a store that accepts them, we will delete the contents within 90 days; otherwise, it will be deleted after two years of inactivity. Other personal information will be kept for as long as is necessary to fulfill the purposes for which it was collected or as otherwise required by law or as otherwise described in this Privacy Notice.

  • SUPPLEMENTAL NOTICE FOR CALIFORNIA RESIDENTS

If you live in California, you are required by law to be told the following extra information about how we collect, use, and share your personal information. This section applies to those of you who are located in the state of California. Over the past year, we have collected and may continue to collect the following types of personal information: identifiers, personal information described in California Civil Code Section 1798.80(e), commercial information, information about how you use the Internet and other electronic networks, and inferences drawn from any of the above categories.   • SUPPLEMENTAL NOTICE FOR NEVADA RESIDENTS

If you live in Nevada, you have the right to refuse the sale of certain personal information to third parties who plan to license or sell that information. Please note that we do not currently sell your personal information, as sales are defined in Nevada Revised Statutes Chapter 603A. If you have any questions, please contact us as set forth below.

  • CHILDREN’S INFORMATION

We do not knowingly collect personal information from children under 13 (or any other age required by local law), and we do not market the Services to them. If you are a parent or guardian and you think your child has uploaded personal information to our site without your permission, you can contact us as described in "Contact Us" below. If we find out that a child has given us personal information against the law, we will delete any personal information we have collected, unless we are required by law to keep it, and, if necessary, close the child's account.

  • OTHER PROVISIONS

Third-Party Websites/Applications. Some websites and apps may link to or reference our Services, and the same is true for us. We do not have any influence over these outside providers. Users are strongly advised to familiarize themselves with the privacy policies of each and every website and application with which they interact. Neither the privacy policies nor the content of any third-party websites or apps are under our control and, therefore, neither our endorsement nor our approval is required. If you choose to share your personal information with unaffiliated third-party websites or apps, you do so at your own risk.
